Well I had that court appearance today, and guess what? The officer was on vacation, and he had put in a motion to continue the case for another date, so I have been rescheduled for November 3rd, and have to come back then.

Man....dragging this out is getting old, but worth it if I beat the ticket.



Here's the thing John, it sounds to me like he won't show up, and is hoping you'll send the fine into them, my guess is, he won't show again, and you will win.
An officer will not purge himself, if he knows whats good for him, and if you testify that he said that, then he will look bad, and he knows it... he's blown his case already.
Make sure you show, and if he is there, don't hesitate to fry him with what he said to you, the judge knows it's hearsay, but the cop doesn't want to take the chance, on an innocent guy like you, reporting his behavior, in a small town, trust me.emoticon
It's worth every penny of your time off, and gas, to fight it, he has already shown a sign of weekness, don't let him win.
It's not about your driving violation, it's about his conduct, and he knows it.

Thanks for your vote of confidence. But one thing worries me:

This particular judge...I had a chance to see him in action, and it would appear he's very "give-them-the-benefit-of-the-doubt-ish" to the officers in his jurisdiction.

Like a chair umpire at Wimbledon that will not overrule his linesman unless there is a clear error in the call, I see this judge as backing his officers at almost all costs.

I fear that the crux of the case is not going to be whether I was confused by what was legal vs. illegal by misinterpreting the painted arrows on the ground; but rather at the end of the day did I or did I NOT make an illegal right turn from a "straight only" lane?

Even I must admit, that upon going back to the intersection with my cell phone camera and taking pictures, there is a "straight only" arrow clearly marked at the front of the lane.

The fact that I couldn't see it from 200 ft. back, and it caused me to make an errant decision, I'm not sure is what the case is about. The judge may in fact feel bad for me under the circumstances, but if the basis for throwing the ticket out of court hinges upon whether or not the cop was correct in issuing the ticket, I'm afraid I may not stand much of a chance.

But if my misinterpretion of the arrows is allowed to come into play, I think I stand at least a 50% chance of winning this thing.

Depends on the crux of the whole case.

It's worth standing up for, if anything just to get them all to work that day, cause you have to take the day off.emoticon

Well yes, and I couldn't agree more with that.

This is the third time I will have been inconvenienced by this...not to mention the day I got the ticket to begin with. If I have to miss work and raise the eyebrows of my boss and my dispatcher, while they use other drivers to cover my stops and routes, why shouldn't these civil servant yahoos be at least slightly inconvenienced also?

It's a racket!
If they put a wrong charge code on your ticket, it goes on your record, if you spot it, you have to take the day off, go down there, stand in a long line at the records office, get a copy of your ticket, take it to the clerk, and have it fixed in the system.
Why, when they can walk down the hall, pull the tcket, and fix their own stupid mistakes?
They are at work, and we have to take the day off, it doesn't make very much sense, such as the bottom feeding they do.
