The band Survivor had even more unbelievable issues like the one talked about here.
The original line up had Dave Bickler on vocals. Jimi Jamison replaced him for 3 albums and the band disbanded. At that time they all went their seperate ways and a few years later The guitarist and singer each wanted to reform Survivor but without the other one involved. They both did so and Jamison had no other members of Survivor from any line up. Yet the name was never copy righted back when Survivor was originally formed. Jamison beat the others to the punch and copy righted it for himself. Both bands hit the road and went under the same name. Eventually it made it to court and when it was all said and done Jamison won the legal battle. After all that they all got back together anyway.
Hows that for a mess

I don't know..I'm kinda partial to the Tribute band being called "The Widdlin, Wibblin Travelin Woobedas Featuring The Songs Of Ritchie Blackmore" if Blackmore decides he wanted to call his touring Idols Deep Purple.
What name would you suggest for the current Blackmore Tribute band when they are forced to change thier name?

Unless 35 years of managers are wholly incompetent, someone somewhere will own the name - probably conditionally. We just don't know who owns it and under what conditions. The name may be owned by Bruce Payne and Roger Glover. After a drunken contract negotion evening back in 1983, Roger Glover can only maintain his rights to the band name if he always wears a hat or a bandana ...
While there will always be a legal ownership issue with bands using other members, there is also a market issue - a lot of people will give up on a band that doesn't command respect with its line up changes - I have no doubt that Eddie and Alex Van Halen have legal rights to use their surname for a band, but the market wouldn't cope with Gary Cherone as vocalist. However, fans of Whitesnake, Rainbow etc allow their bands to run through dozens of members as long as the key person stays put.

I think Gillan and Glover have the main legal say in Deep Purple nowadays.
And I don't think Blackmore is going to object to his nemesis using the Deep Purple name as long as he gets the royalty money from every tour that they do so he can continue to buy the best in tights and cod pieces.
Edited to add that other bands facing this issue is the person who has been in the band the longest or contributes most to the band recently has the legal rights to the name.
Case in point.
Black Sabbath - Tony Iommi.
Yes - Chris Squire.
Uriah Heep- Mick Box.

I sure hope not. Tony Iommi was great, and is still great. Ozzy however, was never that great, and is only worse now.
Also, Jimmy Page has pretty much all the say in Led Zeppelin stuff. He owns Robert Plant's share of Led Zeppelin. He must of had to line his pool with gold, that is why there is a bunch of Led Zeppelin best of's out lately.
